Fraser Dawbarns would like to congratulate Associate Amy Pettitt for passing the STEP Advanced Certificate in Trust Disputes with a distinction.

Amy is already a full STEP member having passed the STEP Certificate in Trusts and Estates (England & Wales) with a distinction in 2015.  Amy wanted to continue her studies to gain more knowledge in the complex and varied area of trust creation and administration.

The STEP Advanced Certificate in Trust Disputes is an international distance learning course drawing upon case law and legislation from many different jurisdictions.  The course covers the common areas of trust dispute including sham, validity, interpretation, investment disputes, disclosure, and breach of trust.  The course is assessed by a 4000 word essay.  Candidates are required to research and advise on a problem scenario involving multiple parties and issues based upon the law of their own jurisdiction.

Amy is delighted with her grade, saying:

I am so pleased that I have passed the Advanced Certificate in Trust Disputes. I thoroughly enjoyed this challenging and highly technical course.  I spent a considerable amount of time researching, considering and writing the assignment.  I am happy that my hard work has paid off.  I am very grateful to Fraser Dawbarns for their support and encouragement which has allowed me to gain this additional qualification and specialist knowledge.

In my experience, many people misunderstand what a trust is and therefore they do not appreciate the consequences of creating a trust, the beneficiary’s entitlements under the trust, or the incredibly onerous duties and responsibilities of the trustees. The result is often disappointed parties, which, in turn, can lead to costly and stressful litigation. The course will greatly assist me to advise clients when a trust dispute arises, but, more importantly, I can advise my clients on how to avoid such disputes by ensuring that best practices are employed when creating and managing trusts.
