If you are an employer, the answer is ‘only if you have a Tribunal claim brought against you and lose’.
The consultation, which started in late January and will conclude in late March, proposes that claimants will in due course need to pay a £55 issue fee in order to bring a claim. The fee would remain at £55 regardless of the number of complaints being raised or the number of claimants on the form.
As an employer, this will only affect you to the extent that if you lose, the Tribunal will probably require you to reimburse the £55 that the claimant has had to pay at the outset.
The proposals are understood to be part of a broad attempt by the Ministry of Justice to bring some consistency to the fee structures of the various civil courts and Tribunals and also to encourage claimants to resolve their disputes via Acas early intervention. The money raised from the fees will potentially be reinvested in the Acas dispute resolution system.
