Neil John, who heads the personal injury team at Fraser Dawbarns, has recently settled the fatal injury claim for family of construction industry worker who was working in a building at height, fell and didn’t survive the fall.
Neil comments: “Sadly, the construction industry still sees more workplace accidents than most other sectors. In this instance, we negotiated a settlement against the main site contractor and the sub-contractor to whom the deceased was contracted. There was a Health & Safety Executive investigation into the incident and the injury claim settled on the basis that if it had been pursued further, the insurers would have been alleging that the deceased construction worker had contributed to the accident by not taking fully appropriate safety measures. ‘Contributory negligence’ is a fairly common problem in personal injury claims, and you can still bring a very worthwhile claim if the injuries sustained were only partly someone else’s fault.”
