Personal injury specialist Neil John, a partner at Fraser Dawbarns, has obtained a £40,000 settlement for a man who was hit from behind by a fork lift truck. The man, who was working in a factory at the time of the incident, suffered a foot and ankle injury as a result and was unable to return to work for several months. He is expected to have some ongoing issues with the mobility of his ankle as a result.
Neil adds: “Due to the potential longer-term problems that may be experienced as a result of this injury, the final settlement would have been slightly higher if our client had followed his workplace’s procedures in full but a small amount was forfeited for ‘contributory negligence’. This is not unusual and it is always worth checking whether you may have an injury claim even if you know that you may have been partially to blame for what happened to cause your injury”.
